These Terms of Use ("Terms") are a legally binding agreement between you and Curastem governing your access to and use of curastem.org, including text, images, layout, and the Donate function (the "Site").
Curastem is a U.S. 501(c)(3) nonprofit (EIN 39-2326761), 4958 Sereno Drive, Temple City, CA 91780, USA.
Please read these Terms and our Privacy Policy at curastem.org/privacy before using the Site. By accessing or using the Site, or by making a donation through a Donate link on the Site, you agree to these Terms. If you do not agree, do not use the Site.

Using the Site
1. What the Site is
The Site describes Curastem’s mission, programs, and how to contact or support the organization. Content is for general information. It is not legal, tax, accounting, immigration, or employment advice. You should not rely on the Site as a substitute for professional advice about your situation.
We also operate a separate website that helps people search and apply to jobs. That website is not the Site. These Terms do not license that product, create an account there, or replace that product’s terms. Links or descriptions on the Site do not make Curastem a party to any employment relationship.
2. Eligibility
You must be able to form a binding contract to donate. In the United States that generally means 18 years of age, or the age of majority in your state, unless a parent or legal guardian donates on your behalf and accepts these Terms.
You must not use the Site if applicable law prohibits you from doing so, including U.S. sanctions and export rules.
The Site is not directed to children under 13.
3. No account on this domain
The Site does not offer user accounts, paid subscriptions, API keys, or job applications. If you need product features, use the separate website we operate for that purpose, under its own terms.
4. License to use the Site
We grant you a limited, revocable, non-exclusive, non-transferable license to access and display the Site for lawful, personal, or internal organizational information purposes. You may not copy, scrape at scale, reverse engineer, frame, mirror, or commercially republish the Site except as allowed by mandatory law (for example, brief fair-use quotation) or our prior written permission.
5. Acceptable use
You agree not to:
Use the Site for any unlawful purpose, or to violate another person’s rights.
Attempt to probe, scan, or test the vulnerability of the Site, or to breach security or authentication, except with our written authorization.
Interfere with or disrupt the Site, including by malware, flooding, or imposing unreasonable load.
Use the Site to send spam, phishing, or unsolicited bulk messages.
Impersonate Curastem, a donor, or any person, or misrepresent your affiliation.
Submit false donation information or attempt to launder funds.
Harvest emails or other data from the Site except through means we expressly provide (such as writing to hello@curastem.org).
Circumvent technical measures that limit access to the Site.
We may suspend or block access, including by IP or other technical means, if we believe you violated these Terms, created risk to the Site or others, or if required by law.
Donations
6. Nature of a donation
A donation made through Donate or another Curastem Stripe Checkout link from the Site is a voluntary charitable gift to Curastem. It is not a purchase of goods, services, software licenses, job-search access, API credit, or any paid plan. Completing a donation does not create a customer-vendor relationship for a commercial product.
You represent that you are authorized to use the payment method, that the gift is not made to evade law, and that information you provide is accurate.
7. Processing
Payments are processed by Stripe. You must also comply with Stripe’s terms presented at checkout. We do not store full payment-card numbers. Currency, minimums, and available methods are shown at checkout and may change.
8. Receipts and tax
After a successful gift we typically email a receipt. U.S. donors may be eligible for a charitable contribution deduction to the extent allowed by the Internal Revenue Code and their own facts. Curastem does not provide tax advice. Deductibility can depend on your itemization, substantiation, and other rules. Keep your receipt. Non-U.S. donors are responsible for local tax treatment.
9. Refunds
Gifts are generally not refundable once processed, except where required by law, where we determine a duplicate or unauthorized charge occurred, or where we cancel a gift before it is completed. If you believe a charge was made in error, email hello@curastem.org promptly with the date, amount, and email used at checkout. Chargebacks filed with a bank without contacting us first may delay our ability to help.
10. No earmarking unless we agree in writing
Unless we expressly agree in a separate writing, donations are unrestricted support for Curastem’s charitable mission. We may allocate funds among programs as the board and management determine, consistent with law and our exempt purpose.
Content and intellectual property
11. Our content
The Site, including text, graphics, logos, photographs, layout, and compilation, is owned by Curastem or its licensors and is protected by copyright, trademark, and other laws. "Curastem" and the Site design are identifiers of the organization. You may not use our marks in a way that suggests sponsorship or endorsement without permission.
12. Feedback
If you send ideas or feedback to hello@curastem.org, you grant Curastem a worldwide, royalty-free, irrevocable license to use that feedback without restriction or obligation to you, to the extent the law allows. Do not send confidential information you wish to keep secret.
13. Copyright complaints (DMCA)
We respond to notices of claimed copyright infringement under the U.S. Digital Millennium Copyright Act. Designated agent: Curastem, 4958 Sereno Drive, Temple City, CA 91780, USA; hello@curastem.org. Send a notice that includes your contact details, identification of the copyrighted work, the URL of the material, a statement of good-faith belief that use is not authorized, a statement under penalty of perjury that you are the owner or authorized to act, and your signature.
We will remove or disable alleged infringing material when required and may terminate repeat infringers in appropriate circumstances. If material was removed by mistake, you may send a counter-notification to the same agent.
Third parties and other sites
14. Third-party services
The Site may link to Stripe Checkout, email, or other third-party services. We do not control those services. Your use of them is governed by their terms and privacy notices. We are not responsible for their content, availability, or practices.
15. Job listings and outcomes
Nothing on the Site promises you a job, interview, visa, or particular salary. Descriptions of programs are informational. Employers, not Curastem, make hiring decisions on roles they control.
Disclaimers, liability, and disputes
16. Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURASTEM DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT CONTENT IS ACCURATE OR COMPLETE.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURASTEM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SITE, DONATIONS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURASTEM’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU DONATED TO CURASTEM THROUGH THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for a consumer’s non-waivable statutory rights. Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the fullest extent permitted.
18. Indemnity
If you use the Site in connection with a business, organization, or commercial activity, you will defend and indemnify Curastem and its officers, directors, employees, and agents against claims, damages, losses, and reasonable attorneys’ fees arising from your misuse of the Site, your content, or your violation of these Terms or law, except to the extent caused by our willful misconduct. This section does not apply to an individual using the Site solely for personal, non-commercial purposes, except where the claim arises from unlawful use.
19. Suspension
We may change, suspend, or discontinue the Site at any time. We are not obligated to keep any particular page available. Provisions that by their nature should survive (including donations already completed, intellectual property, disclaimers, limitation of liability, and governing law) survive.
20. Governing law and venue
These Terms are governed by the laws of the State of California, excluding conflict-of-law rules, and by applicable U.S. federal law (including the DMCA). Subject to mandatory consumer protections in your place of residence, you and Curastem agree that state and federal courts located in Los Angeles County, California are the exclusive venue for disputes arising out of the Site or these Terms, and you consent to personal jurisdiction there.
Before filing a claim, you agree to email hello@curastem.org with a short description of the dispute and to allow thirty (30) days for an informal resolution, unless waiting would cause irreparable harm or the claim seeks injunctive relief for intellectual property.
21. Export and sanctions
You may not use the Site or donate if you are located in a comprehensively sanctioned jurisdiction or if you are a denied or restricted party under U.S. law. You agree to comply with applicable export-control and sanctions laws.
22. Miscellaneous
These Terms and the Privacy Policy are the entire agreement between you and Curastem regarding the Site. They supersede prior understandings about the Site. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a reorganization of the nonprofit. Headings are for convenience only. "Including" means "including without limitation."
23. Changes to these Terms
We may update these Terms by posting a new version on this page and changing the Last updated date. Material changes apply going forward. If you continue to use the Site after an update, you accept the new Terms, except where the law requires additional consent. For donations already completed, the Terms in effect at the time of the gift continue to apply to that gift except as the law requires.
